New Battery EPR Rules Coming in 2025 – Sellers Must Prepare Now

Beginning August 18, 2025, Amazon will enforce Extended Producer Responsibility (EPR) compliance for battery-containing products sold across its European marketplaces. This update aligns with the European Union’s stricter environmental regulations aimed at enhancing product lifecycle management.

What is Extended Producer Responsibility (EPR)?

Extended Producer Responsibility (EPR) is an environmental policy that requires producers—including manufacturers, importers, and online sellers—to take full accountability for the entire lifecycle of their products. This includes not only design and sale but also collection, recycling, and disposal after the product’s end of use.

To comply with EPR regulations, businesses must register with local authorities in each country where they sell, declare the relevant product types and quantities, and pay applicable eco-contribution fees. This mechanism encourages brands to develop more sustainable products by factoring in their environmental impact from the start.

Within the EU, several directives have been issued, and each Member State is required to implement them at the national level. While there is no single EU-wide EPR scheme, the Battery Directive and the directly applicable Battery Regulation are already in force across the bloc.

Who is Affected?

The EPR rules apply to all parties considered “producers” under EU law, including:

  • Manufacturers

  • Importers

  • Brand owners

  • Online and distance sellers (including Amazon sellers)

The battery category covers a wide range of items, including:

  • Single-use batteries

  • Rechargeable batteries

  • Automotive and electric vehicle batteries

EPR requirements apply whether you sell batteries as standalone items or as part of a product that contains them.

Amazon's EPR Enforcement Timeline and Affected Marketplaces

Starting August 18, 2025, Amazon will require sellers of battery-related products to provide valid EPR registration numbers for listings in the following countries:

  • France

  • Germany

  • Italy

  • Spain

  • Netherlands

  • Belgium

  • Poland

  • Sweden

Each product listing that includes batteries must be linked to a valid EPR registration number for each country where it is sold. If you operate in multiple markets, separate EPR numbers must be submitted accordingly.

To help sellers manage compliance, Amazon has introduced a centralized Compliance Portal where required documentation can be uploaded and monitored.

Additional EU Requirements: CE Certification and Responsible Person

In addition to EPR compliance, products containing batteries must also be CE certified under EU product safety laws. It is illegal to sell battery products in the EU without CE marking, even if EPR requirements are met.

Moreover, sellers not established within the EU must appoint a Responsible Person, based in the EU, to act as a regulatory liaison for product safety and compliance.

What Happens If You Don't Comply?

Amazon will take enforcement action if valid EPR registration numbers are not provided by the deadline. This may include:

  • Automatic enrollment into Pay on Behalf in France and Spain, where Amazon declares EPR on your behalf for an added fee

  • Listing removal or ASIN deactivation

  • Account suspension, either in specific regions or across all Amazon EU marketplaces

Failure to obtain CE certification or appoint a Responsible Person may also trigger legal penalties, such as:

  • Product seizure or destruction at customs

  • Fines or confiscation of sales revenue
