Amazon Pan-EU Adds the Netherlands – Sellers Must Review EPR Now

From 3 September 2026, new and existing Pan-European FBA products must have an active Amazon.nl listing to enrol in or retain Pan-EU benefits. From 26 February 2027, Belgium will also become a required listing.

A required listing does not automatically mean Dutch inventory, immediate Dutch VAT registration or immediate Dutch packaging registration. It does mean sellers should reassess their destination-country VAT and Extended Producer Responsibility (EPR) exposure.

What Has Changed for Amazon Pan-European FBA?

Amazon now requires eligible FBA products to use the same SKU across the required stores in Germany, France, Italy, Spain and the Netherlands.

  • Netherlands: active listing required for all new and existing Pan-EU products from 3 September 2026.

  • Belgium: active listing required from 26 February 2027.

  • Sweden, Ireland and Poland: listings remain optional under Amazon’s current published programme information.

The commercial footprint of Pan-EU FBA is expanding, but marketplace listing, inventory storage and consumer destination remain three separate compliance questions.

Does an Amazon.nl Listing Automatically Require Dutch VAT Registration?

Not necessarily. Amazon distinguishes between a marketplace where a product is offered and a country where Amazon is authorised to store the seller’s inventory.

Amazon states that a VAT number is required for each country where goods are stored, while a VAT number is generally not required merely because a destination store is enabled.

Sellers should confirm whether the Netherlands is only a sales destination or is also an inventory-placement country. Import arrangements, stock movements, the transaction chain and use of the Union One Stop Shop (OSS) may also affect the VAT position.

Does Selling on Amazon.nl Trigger Dutch Packaging EPR?

Possibly. Dutch packaging EPR is not determined by whether the seller holds a Dutch VAT number. The key question is who first places the packaging or packaged product on the Dutch market.

Dutch government guidance states that manufacturers and importers are responsible for packaging and packaged products brought onto the Dutch market. A foreign business supplying packaged goods directly to Dutch consumers may therefore fall within the applicable producer or importer framework.

Because an Amazon.nl listing increases the likelihood of actual Dutch consumer sales, sellers should identify the responsible producer, map the packaging used for each SKU, and record packaging weight and material composition.

Do All Amazon.nl Sellers Need to Register with Verpact Immediately?

No. Under current Dutch guidance, businesses placing 50,000 kg or more of packaging material on the Dutch market in a calendar year must pay the packaging waste management contribution to Verpact and report the relevant quantities.

However, the general threshold should not be treated as a blanket exemption. Single-use plastic obligations and the Dutch deposit-return system operate under different rules and may require action below the general packaging threshold.

The correct approach is to determine whether the seller is the Dutch producer and whether the packaging category or annual quantity triggers registration, reporting, payment or other obligations.

Why PPWR Changes the Longer-Term Risk

The EU Packaging and Packaging Waste Regulation (PPWR), Regulation (EU) 2025/40, began applying from 12 August 2026. It creates a more harmonised EU packaging framework while preserving important country-level producer-registration and EPR implementation requirements.

For distance sales, the producer analysis increasingly follows the destination market. A business established in another EU Member State—or outside the EU—may be treated as a producer when it makes packaged products available directly to end users in another Member State.

PPWR also increases the importance of marketplace verification. Online platforms are expected to collect relevant producer-registration information and a self-certification of EPR compliance, and to make reasonable efforts to assess whether the information is complete and reliable.

The practical risk is shifting from environmental-authority enforcement alone toward platform-level controls that can affect listing availability.

Belgium Is the Next Pan-EU Checkpoint

Amazon has announced that Belgium will become a required Pan-EU listing from 26 February 2027. Sellers should use the lead time to assess Belgian packaging EPR, the applicable producer definition under PPWR and whether an EPR authorised representative may be required.

Implementation details may continue to evolve. Seller-specific planning should follow current Belgian and Amazon guidance rather than assumptions carried over from Germany, France or the Netherlands.

What Should Pan-EU Sellers Check Now?

  • Confirm every country in which each SKU has an active marketplace listing.

  • Download Amazon inventory and cross-border movement reports to identify every storage country.

  • Map consumer destination countries using actual order data.

  • Identify the responsible producer for packaging, WEEE, batteries and category-specific EPR streams.

  • Record packaging weights and material types by SKU and destination country.

  • Check Dutch single-use plastic and deposit-return exposure separately from the general packaging threshold.

  • Review VAT registrations and OSS arrangements independently from EPR.

  • Prepare producer-registration numbers and supporting evidence before a marketplace requests them.

  • Add Belgium to the 2026–2027 compliance roadmap.

Do not combine active listings, inventory placement and consumer destinations into one question. They affect marketplace eligibility, VAT and EPR in different ways.

Pan-EU Country Snapshot

  • Germany: VAT, LUCID packaging, WEEE and battery obligations.

  • France: VAT and applicable REP streams, including packaging, WEEE and batteries.

  • Italy: VAT, packaging, WEEE and battery requirements.

  • Spain: VAT and packaging, WEEE and battery EPR.

  • Netherlands: packaging EPR, SUP, deposit-return exposure and inventory-based VAT.

  • Belgium: packaging EPR, PPWR producer status and authorised-representative requirements.

  • Poland, Sweden and Ireland: optional Pan-EU listings, although local VAT and EPR duties may still arise.

Frequently Asked Questions

Is an Amazon.nl listing mandatory from 3 September 2026?

Yes, for new and existing products participating in Pan-European FBA. Sellers outside Pan-EU FBA should not automatically apply this programme condition to their products.

Does an Amazon.nl listing automatically require a Dutch VAT number?

No. Amazon distinguishes the destination store from countries where stock is stored. Inventory placement and the specific transaction structure should be reviewed.

Does every Amazon.nl seller need Dutch packaging EPR registration?

No. The answer depends on producer status, packaging category, annual quantity and whether single-use plastic or deposit-return rules apply.

Can a non-EU business be responsible for Dutch packaging EPR?

Yes. A foreign business selling packaged goods directly online to Dutch consumers may fall within Dutch producer or importer responsibilities.

Will Amazon request a Dutch EPR registration number?

Marketplace verification is expected to become stricter under PPWR. Sellers should follow current Seller Central notices for the timing and product categories of any specific Amazon.nl submission requirement.

When does Belgium become a required Pan-EU listing?

Amazon’s published date is 26 February 2027.
